Terms and Conditions of Memorial Press USA

By placing an order you are agreeing to these terms and conditions.

General Terms

In some instances, photographs can still be under the copyright ownership of the hired photographer. When we receive an image from you, we do so on the understanding that if it was taken by a professional photographer, you have obtained permission to use it or the photo is not subject to copyright.

Prayers/poems/lyrics can still be under the copyright ownership of the author who wrote them. When we receive a prayer/poem from you, we do so on the understanding that it is either the public domain, no longer under copyright, self authored, or you have obtained permission to use it.

In giving your approval of the proof for printing of your memorial card product you are approving the following:

  • Final design
  • All text accuracy, spelling, color and grammar (including names, dates, prayer, etc.)
  • Any images used in the design
  • Quality of the final image. Images will print with the exact quality as we have received and as is shown on the final proof.

When you visit Memorial Press USA or send e-mails to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you via e-mail. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

Please review our other policies, such as our privacy policy, posted on this site. We reserve the right to make changes to our site, policies, and these Terms of Service at any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.

Delivery and shipments late or delayed

Memorial Press USA will make every reasonable effort to deliver your products according to your requested delivery date; however, the delivery date is not guaranteed and do not form part of the contract.

It is your obligation to enter the correct delivery address details at the time of ordering on the Memorial USA website. Should you enter the wrong address, we are not obliged to re-send the order to the correct address at our expense.

We will provide you with an estimated delivery date and tracking number (when available) for all parcels. While we make every reasonable effort to deliver by this time but all dates specified are estimates only and we are not responsible for any delays. In spite of all our efforts, there can sometimes be unforeseen delays in delivery.

Without limiting Terms of Service herein, Memorial Press USA will not accept liability for any costs or losses arising or damage suffered due to late delivery and you agree that late delivery does not constitute a failure of our agreement or entitle you to cancel your order or receive a refund. We will not accept liability for any loss or damage arising from items lost, stolen or damaged after delivery has taken place.

If delivery of your memorial card order by overnight delivery, two day delivery or Priority Mail delivery has been delayed/late for reasons beyond Memorial Press USA’s control we will refund the total cost of the shipping fee only. Request of refund for delayed/late overnight fee must be requested in writing by e-mail with-in seven days and must include the tracking number for the shipment.

Copyrights

All bible passages, poems, prayers, photographs, artwork, images on this website are the property of their respective copyright owners and may not be downloaded, copied or reproduced. Memorial Press USA has purchased the rights to use most of the images and content on this website, or is the sole copyright owner of many of the images. Some of the images and prayers/poems contained on the Memorial Press USA are believed to be posted within our rights according to the U.S. Copyright Fair Use Act (title 17, U.S. Code.) If you believe that any content appearing on memorialpressusa.com infringes on your copyright, please let us know by emailing us and the infringing material will be removed as soon as possible.
